TERMS & CONDITIONS

Please read these terms and conditions of entry carefully. By submitting an entry to this promotion, you are deemed to have read and accepted them.

  1. PROMOTER: A.G. BARR p.l.c., a company registered in Scotland with company number SC005653, and having its registered office at Westfield House, 4 Mollins Road, Cumbernauld, G68 9HD (the “Promoter”, “we”, “us”, “our”).
  2. PROMOTIONAL PERIOD: promotion opens at 00:01 on Monday 5 May 2025 and closes at 23:59 on Monday 30 June 2025 (inclusive) (the “Promotional Period”).
  3. ELIGIBILITY:
    1. The promotion is open to legal residents of the United Kingdom aged 18 years or over only, excluding: (i) our employees, (ii) our agents and (iii) anyone professionally connected with the promotion, and (iv) the immediate family members of (i), (ii) and (iii).
    2. Qualifying Product purchase is necessary (see condition 4 for details). Please retain an itemised receipt that states the time and date of the Qualifying Product purchase prior to entry, but within the Promotional Period, as this may be required for validation and in order for a winner to receive their Prize.
    3. Device with QR scanning capabilities and internet access required. A valid email address and mobile number is also required to enter. Normal exclusions apply. Any entries received before or after the Promotional Period will not be valid and will not be entered into this promotion.
    4. Maximum one entry per device per day is permitted during the Promotional Period. Repeated entries on the same device on the same day will be disregarded at the Promoter’s sole discretion.
    5. We will have no responsibility for, and will not accept, any entries that are lost, delayed, incomplete, illegible, damaged or corrupted (including as a result of postal delays, technical issues with your mobile, tablet, computer or connectivity, or technical issues with our website).
  4. Qualifying products

    The products specified in this condition 4 are each considered a qualifying product necessary for entry (referred to individually as a “Qualifying Product”).

  5. TO ENTER:

    To enter during the Promotional Period you must:

    1. purchase a Qualifying Product;
    2. access the entry form by:
      1. using your mobile phone or other device to scan the promotional QR code shown on the product’s display or promotional material; or
      2. texting “FESTIVAL” to 66777 and clicking the link in the response text; or
      3. visiting www.winrubiconfestivals.com;
    3. complete the pop-up / online entry form with the required details (including your full name, email address, mobile number, the batch code and barcode of your purchased Qualifying Product); and
    4. submit the completed form.

      Verify your entry by entering the one-time passcode you receive to the mobile number you provided in the entry form. If you do not verify your entry, your entry will not be counted and you will not be eligible to win a Prize.

      Promotional QR codes can be found on point-of-sale material in a number of retailer stores; shared on Rubicon’s social media sites; Rubicon out-of-home promotional sites; and on shopper facing websites and social media Platforms.

  6. Any entries received before or after the Promotional Period will not be valid and will not be entered into this promotion. Maximum 1 entry per person per day during the Promotional Period.
  7. PRIZES: Throughout the Promotional Period, there are 149 prizes in total available to be won, with each prize to be randomly allocated to winners. Each winner will be randomly allocated to receive one of the following prizes:
    1. 1 x pair of weekend tickets for Leeds Festival 2025, with campsite entry from Thursday 21 August 2025.

      Three pairs of festival tickets in total for entry to Leeds Festival will be available to win over the 8-week Promotional Period, determined by open winning moments.

    2. 1 x pair of weekend tickets for entry to Reading Festival 2025, with campsite entry from Thursday 21 August 2025.

      Three pairs of festival tickets in total for entry to Reading Festival will be available to win over the 8-week Promotional Period, determined by open winning moments.

    3. 1 x weekend ticket to Creamfields Festival on 21 August 2025 with Standard campsite entry.

      Four pairs of festival tickets in total for entry to Creamfields Festival will be available to win over the 8-week Promotional Period, determined by open winning moments.

    4. 1 x weekend ticket to Wilderness Festival 2025 on Thursday 31 July 2025 with General campsite entry.

      Four pairs of festival tickets in total for entry to Wilderness Festival will be available to win over the 8-week Promotional Period, determined by open winning moments.

    5. 1 x pair of tickets to Boomtown Festival 2025 with campsite entry on Wednesday 6th August 2025.

      Ten pairs of tickets in total for entry to Boomtown Festival will be available to win over the 8-week Promotional Period, determined by open winning moments.

    6. A 6-month subscription to Spotify. 75 subscriptions to be won; and
    7. A £100 Love2Shop digital voucher. 50 digital vouchers to be won.
  8. PRIZES SPECIFIC T&Cs:

    For Prizes (a) and (b):

    1. The Winner and their chosen companion must be over 18 years of age at the opening date of Reading & Leeds Festival 2025, being Thursday 21 August 2025 (subject to change at the sole discretion of the event organiser). Any attendee under the age of 18 must comply with the requirements of the festival.
    2. By accepting a prize, winners agree to the Reading & Leeds Festival 2025 tickets terms and conditions found here: www.ticketmaster.co.uk/reading-and-leeds-festival/terms-and-conditions/#readingfestival
    3. Once the winner and guest have registered with Reading & Leeds Festival 2025 and tickets have been allocated, the winner and guest will be subject to any cancellation policies that Reading & Leeds Festival 2025 may impose in accordance with the ticket terms and conditions. The winner will be treated in accordance with any other ticketholder.
    4. Weekend Tickets are valid for campsite entry from 03:00 (Leeds) or 08:00 (Redding) on Thursday 21st August 2025.
    5. Reading & Leeds Festival 2025 do not accept Print at Home tickets, Booking Confirmations, screenshots or photos of tickets. Each individual attending must present their own individual ticket at the gate to have the barcode scanned.
    6. Tickets for this event have a unique barcode which will be scanned on entry and if found to be duplicated, either in error or for fraudulent gain, only the first instance of the ticket scanned will be admitted regardless of original ownership. Customers may be prosecuted if found to have deliberately duplicated and resold tickets for fraudulent gain.
    7. Wristbands removed from the wrist, cut or tampered with will be rendered invalid and will not be replaced. Reading & Leeds Festival 2025 will not replace lost or stolen wristbands regardless of proof of purchase.

    For Prize (c):

    1. The Winner and their chosen companion must be over 18 years of age at the opening date of Creamfields Festival 2025, being Thursday 21 August 2025 (subject to change at the sole discretion of the event organiser).
    2. By accepting a prize, winners agree to the Creamfields 2025 tickets terms and conditions found here: creamfields.com/terms/
    3. Once the winner and guest have registered with Creamfields Festival 2025 and tickets have been allocated, the winner and guest will be subject to any cancellation policies that Creamfields Festival 2025 may impose in accordance with the ticket terms and conditions. The winner will be treated in accordance with any other ticketholder.

    For Prize (d):

    1. The Winner and their chosen companion must be over 18 years of age at the opening date of Wilderness Festival 2025, being Thursday 31 July 2025 (subject to change at the sole discretion of the event organiser).
    2. By accepting a prize, winners agree to the Wilderness 2025 tickets terms and conditions found here: www.wildernessfestival.com/legal/terms-and-conditions-of-entry/
    3. Once the winner and guest have registered with Wilderness Festival 2025 and tickets have been allocated, the winner and guest will be subject to any cancellation policies that Wilderness Festival 2025 may impose in accordance with the ticket terms and conditions. The winner will be treated in accordance with any other ticketholder.

    For Prize (e):

    1. The Winner and their chosen companion must be over 18 years of age at the opening date of Boomtown Festival 2025, being Wednesday 6th August 2025 (subject to change at the sole discretion of the event organiser).
    2. By accepting a prize, winners agree to the Boomtown 2025 tickets terms and conditions found here: www.boomtownfair.co.uk/legal/terms
    3. Once the winner and guest have registered with Boomtown Festival 2025 and tickets have been allocated, the winner and guest will be subject to any cancellation policies that Boomtown Festival 2025 may impose in accordance with the ticket terms and conditions. The winner will be treated in accordance with any other ticketholder.
    4. The ticket shall be shared from Boomtown’s dashboard prior to the Festival (minimum three days before). This shall be sent to the email address entered at the point of entry.

    For Prizes (a), (b), (c), (d) and (e):

    1. The Winner and their chosen accomplice are over 18 years old at the opening date of the said Festival.
    2. Tickets will be administered in the winners and their guests’ full names. Winners will need to provide a valid form of ID (Passport, Driving Licence or Official ID that contain the certified PASS logo showing over 18) when entering the Prize Festival 2025 and may be refused admission if they cannot verify their identity as the named ticketholder. Winners are responsible for providing correct details and the Promoter will not be liable for any mistakes made.
    3. Prizes cannot be sold or exchanged.
    4. If for any reason the event is not capable of running as planned, such as cancellation or any other cause beyond the control of the Promoter which affects the running or conduct of this promotion, the Promoter may in its sole discretion cancel the prize and not re-award any additional tickets to the winner or reimburse any incurred expenses by the winner as a result of winning or accepting the prize.
    5. For the avoidance of doubt, the Prize does not include travel/transportation, accommodation (including tents), food, beverages, souvenirs, gratuities, car parking charges, excess baggage, premium bathroom usage, additional excursions and attractions or any other costs of a personal nature (including spending money) that are not explicitly set out in these Terms and Conditions and neither the Promoter nor any provider of any part of the Prize will be responsible for any such costs.
    6. It will be the winner’s and (if applicable) their guest's responsibility to take out at their own cost all relevant insurance (including but not limited to health and travel insurance, insurance for theft, loss and damage to property) which may be required or prudent to be taken.
    7. Winners are responsible for the behaviour of themselves and their guests whilst taking the Prize. The Promoter reserves the right in its absolute discretion to exclude a winner and/or their guests from participation in any aspect of the Prize if any party fails to comply with the directions of the Promoter or any companies associated with the Prize or if a winner and/or their guests act in a manner that is dangerous to themselves or to the public or is, in the opinion of the Promoter, anti-social in any manner or which causes a disturbance or nuisance to others. Failure to comply with these Terms and Conditions may result in refused entry, or the ticket holders being required to leave the event/venue.
    8. Winners and their guests must abide by any relevant terms and conditions which form part of the Prize. It is their responsibility to ensure that they take care when moving around the venue. Whilst at the venue, the winners and their guests must not: be drunk, intoxicated, under the influence of drugs, be abusive, threatening, make or incite racial abuse, chant, use offensive language, make obscene gestures, throw items, behave anti-socially, carry laser pens, bring animals (except guide dogs), carry offensive weapons or illegal substances, carry candles, climb any structure, make excessive noise, offer any item for sale, damage the venue or smoke. Failure to comply with these Terms and Conditions may result in refused entry, or the ticket holders being required to leave the event or venue.
    9. Once tickets have been issued, the Promoter, will not be liable for any failure to comply with its obligations caused by (but not limited to) Acts of God, global or regional epidemic or pandemic, adverse weather conditions, fire, industrial dispute, war, terrorist activity, hostilities, political unrest, riots, civil commotion, plague or other natural calamities, or any other circumstances beyond the control of the Promoter.

    For Prize (f):

    1. The winner will be texted (SMS) the Spotify gift card PIN number to redeem 6 months of Individual membership. 
    2. To redeem the prize, the winner must have or register for a Spotify account in the UK. In order to use or register for a Spotify account you must comply with the applicable age requirements set out in the Spotify Terms and Conditions of Use.
    3. To redeem, winners must visit www.spotify.com/redeem and enter their unique PIN number when requested. 
    4. The Card must be redeemed within 12 months of the date of issue, after which date the PIN will expire and the Card cannot be used for purchase.

    For Prize (g):

    1. The winner will be texted (SMS) a link to a £100 Love2Shop gift card.
    2. To redeem the prize, the winner must click on the link in the SMS and follow instructions on screen.
    3. By accepting the prize, winners agree to the Love2Shop Giftcard terms and conditions found here: www.love2shop.co.uk/product-terms

    We reserve the right to substitute any prize (or an individual aspect of a prize) for an alternative of equal or greater value where we deem it strictly necessary due to events outside our reasonable control. Winners may not transfer the right to accept their prize to another person without our consent. We will not offer cash alternatives to any prizes. Prizes are not negotiable.

    Use of the festival tickets, Spotify subscription, and Love2Shop voucher prizes (where applicable) will each be subject to the terms and conditions set by their respective providers.

    The Promoter is not responsible for any use or failure to use the prizes by the winners, or any acts and omissions of the providers related to them. Winners are encouraged to review the terms and conditions relevant to their prize and raise any issues with the relevant providers directly.

  9. CLAIMING YOUR PRIZE: To claim Prizes (a) - (e) (inclusive), the Winner must have a ticketmaster account. The Winner will be transferred the ticket by the Promotor, or agent responsible for fulfillment.
  10. WINNER SELECTION, NOTIFICATION AND DELIVERY
    1. All entrants will be notified instantly on-screen upon entry submission if they have won a prize.
    2. Winners will be selected by pre-determined open “winning moments” which are specific times during the Promotional Period when a prize can be won. The winning moments have been randomly selected by a secure, independently verified computer programme, and allocated throughout the Promotional Period.
    3. When an individual submits their entry to the promotion, the algorithm will search for an open winning moment timestamp. 149 winning moments have been randomly allocated across the Promotional Period. The first person to submit a valid entry on or after each of these winning moment times will win 1 x randomly allocated prize (see condition 7 for prize details). If no valid entry is received between one winning moment and the next, the prize from that winning moment will roll over to the next winning moment and be available to be won then.
    4. Please note that all 149 prizes are available, but not all may be won if not claimed.
    5. As well as instant notification on-screen, winners will be sent a notification via text to the mobile phone number provided on entry. The notification message will confirm that the winner has won a prize and confirm the details of that prize. We will deliver digital voucher prizes to the winners by email to the email address provided on entry and, if it’s a physical prize, we will ask for the winners UK address to arrange for delivery of prizes to the winners using tracked delivery within 30 days of the date of winner notification.
  11. The Promoter accepts no responsibility for failed delivery due to provision of incorrect contact details. Any prize that is returned undelivered will be assumed unwanted.

The winners’ surnames and counties will be obtainable only by sending a stamped addressed envelope request to: Shopper Marketing Manager (RUBICON - Win Big Festival Flavour- Winning Moment Giveaway, 05 May – 30 Jun 2025), A.G. BARR p.l.c., 2nd Floor, Mansell House, Aspinall Close, Middlebrook, Horwich, Bolton, BL6 6QQ, within 3 months of the closing date. The winner may request that their surname and county are not published or request for the amount of information being published to be reduced by contacting the Promoter at the address above. Without prejudice, the Promoter will provide this information to the Advertising Standards Authority on reasonable request.
  3. You must submit your own entry. Entrants who make an entry on someone else’s behalf will be disqualified, at the Promoter’s discretion. Bulk, trade, group or third party entries will not be accepted. Entries submitted using automated entry software or any other mechanical or electronic means that enable a person to enter repeatedly will not be accepted. The entry must be made directly by the person entering the promotion. Only genuine valid entries will be considered. If it becomes apparent that a participant is using a computer(s) to circumvent this or any other condition by, for example, the use of ‘script’, ‘brute force’ or any other automated means, that person’s entries will be disqualified, and any prize award will be void.
  4. We may carry out verification checks to confirm your eligibility to enter (including requesting proof of ID (e.g. a current passport or driver’s licence) or proof of address (e.g. a recent utility bill)).
  5. Winners are responsible for any tax liability they incur as a result of accepting a prize. Winners are encouraged to seek independent financial advice before accepting a prize if the tax implications concern them.
  6. In the event of suspicious activity, the Promoter reserves the right to request and gather information or obtain further evidence to confirm the legitimacy of the entry/win. We reserve the right to disqualify you if you fail our verification checks or we reasonably believe that you have: (i) breached any of the promotion terms; (ii) cheated or jeopardised the operation or integrity of the promotion; or (iii) gained an unfair advantage or won using fraudulent, dishonest, or unfair methods.
  7. We reserve the right to suspend, vary or cancel a promotion where we deem it strictly necessary due to events outside our reasonable control (including where technical issues are affecting the proper running of the promotion or where we suspect fraud). In these circumstances, we will do all we can to minimise any disappointment.
  8. To the fullest extent permitted by law, we will not be liable to you for any loss, injury or damage which: (i) you suffer by entering a promotion; or (ii) you suffer in the enjoyment of any prize. However, nothing will exclude or limit our liability in respect of personal injury or death caused by our negligence or for any fraud or fraudulent misrepresentation committed by us.
  9. Sometimes, through reasons outside of the Promoter’s control, the website / microsite (as with any website / microsite) may not be accessible. The Promoter cannot guarantee continuous, uninterrupted access to the website / microsite. No responsibility will be accepted for any difficulties in entering, claiming or any entries/claims delayed or corrupted. The Promoter will have no liability for any loss arising out of such an event.
  10. The Promoter may request that the winners participate in publicity arising from the promotion, including taking part in promotional videos and/or photoshoots to be shared via the Promoter’s social media channels. Participation in any such publicity is at the winners’ discretion and is not a condition of enjoying the prize.
  11. At the point you enter this promotion, we’ll give you the option to consent to us using the email address you submit for marketing and promotional purposes. If you give us your consent, we may send you marketing and promotional emails about Rubicon from time to time. If you wish to subsequently withdraw your consent, you can do that by emailing us at dataprotection@agbarr.co.uk, or by clicking the unsubscribe link in any of the marketing or promotional emails we send you.
  12. This promotion is in no way sponsored, endorsed, administered or associated with any other parties, including but not limited to any supermarkets, social media channels, retail stores etc. By entering, entrants agree to release any and all of the non-affiliated parties from any and all liability in connection with the promotion.
  13. Our decision in relation to all matters relating to our promotions will be final.
  14. Each of the promotion terms is separate from the others. This means that if any promotion term is held to be invalid then it will be deleted but the remaining promotion terms will continue to apply.
  15. If there is a discrepancy between these promotion terms and those in any promotional material, these promotion terms will prevail.

  17. The promotion terms will be interpreted and applied in accordance with Scots law. The Scottish courts will have the exclusive right to settle any disputes related to our promotions.
